Consumer Narrative
All residents were fully moved out of XXXXXXXX XXXX XXXX XXXX, TN on XX/XX/XXXX, XXXX days before the lease end date of XX/XX/XXXX. On XX/XX/XXXX, I received an email from XXXX stating that I owed a final balance. I was not notified when the move-out inspection was conducted ( as required by Tennessee law XXXX, nor was I provided any evidence of damages beyond normal wear and tear or the repair invoices and estimates I requestsonly a general list of charges. I was also never asked to sign or acknowledge the damages report, which is also required by Tennessee law. I reviewed the charges and disputed them directly via email with XXXX XXXX XXXX department. They replied on XX/XX/XXXX and again on XX/XX/XXXX, confirming that they received my dispute ; however, evidence/validation was never provided. According to XXXX stated policy, tenants have up to 60 days to resolve a balance before it is sent to a third-party collection agency. However, the account was subsequently sold to IQ Data XXXX while my dispute was still pending. Once the debt was sold, I was never contacted by IQ Data XXXX by mail nor by email. I did not receive the legally required Notice of XXXX that would have informed me of my right to dispute. The first time I learned that IQ Data XXXX was reporting the debt was through a XXXX XXXX alert on XX/XX/XXXX, several months later. Because I was never notified of the transfer or given the XXXX dispute window required under the Fair Debt Collection Practices Act, I was denied the opportunity to exercise my consumer rights. When I later contacted IQ Data XXXX, I was treated unprofessionally by their representative, who attempted to pressure me into taking out a loan and made personal remarks unrelated to the dispute. I have since sent XXXX certified letters requesting validation of the debt, proof of ownership transfer, and all supporting documentation. Both were received ( on XX/XX/XXXX and XX/XX/XXXX ), but I have not received any response to date, neither by mail, nor email. I also reached out to XXXX XXXX XXXX for more information and was told that IQ Data would be able to provide details. I was given an email address to contact IQ Data directly in writing ( XXXX ) ; however, I did not receive a reply. When I asked XXXX XXXX XXXX for further clarification, I did not receive a response from them either.
