Consumer Narrative

In XXXX, I received several federal student loans while attending XXXX XXXX XXXX, XXXX XXXX XXXX, and XXXX XXXX XXXX XXXX. According to the U.S. Department of Educations XXXX XXXXXXXX XXXX XXXX XXXX ( XXXX ), all of those loans were paid in full through a consolidation loan in XXXX. In XX/XX/XXXX, the Department of Education created a new Direct Consolidation Loan totaling approximately {$40000.00} in principal plus {$2600.00} in interest. This included : Direct Consolidated Unsubsidized Loan {$17000.00} principal + {$4000.00} interest XXXX XXXX XXXX XXXX {$22000.00} principal + {$5000.00} interest In XX/XX/XXXX, the loans were assigned to the Departments Default Resolution Group and marked Defaulted, Unresolved. As of XX/XX/XXXX, DOE claims balances of over {$49000.00} combined, although no payments have been credited since assignment. On XX/XX/XXXX, I requested validation and verification of this alleged debt under 34 C.F.R. 30.33 and 31 U.S.C. 3711, including original signed promissory notes, the signed XXXX consolidation agreement, complete payment history, and proof of lawful assignment. DOE responded on XX/XX/XXXX, but only provided balance summaries and a reference to electronic records. They did not provide the required signed promissory notes or the XXXX consolidation agreement. On XX/XX/XXXX, DOE issued a final position letter, stating its position had not changed and refusing to provide further documentation. Despite this, DOE continues to report the alleged debt as Defaulted, Unresolved to credit bureaus and threatens collection actions such as tax refund offsets, wage garnishment, and litigation. This means DOE is attempting to collect and report a debt without providing legally required validation or documentation, in violation of federal regulations.
