This complaint is related to my previous case XXXX XXXXXXXX against Ascent Funding. Despite prior submissions, Ascent Funding continues to bill me ( emails dated XX/XX/year> with repayment schedules attached ) and to call me ( phone records from XX/XX/year> ). This is happening even though they were formally notified in writing that neither I nor my co-signer should be contacted. These actions violate the Fair Debt Collection Practices Act ( FDCPA, 15 U.S.C. 1692c ) which prohibits collection activity when a debt is disputed. Ascents prior response to the CFPB was inadequate and unsupported by evidence. They claimed my training at XXXX XXXX XXXX was adequate, but provided no objective proof of this. In fact, my own construction site XXXX stated that I had wasted my money, he had to remove me from a machine and place me on the ground receiving trucks. Even more, the Human Resources Department of my current employer ( a job I obtained through a personal connection, not through XXXX or the links they provided ) issued a letter confirming the insufficiency of my training and knowledge. This evidence was already submitted in the complaint ending in XXXX. The performance of other students can not be used as evidence against my personal outcome. My direct experience, combined with professional confirmation from my current employer, clearly shows the training was inadequate. I also submitted documentation that XXXX so-called career services consisted only of sending generic job links ( such as XXXX ads ). I did apply to those jobs, and beyond that, I personally submitted hundreds of job applications. The companys claim that I did not take advantage of services is false and dismissive of the facts. Additionally, I reported discrimination and inappropriate conduct at XXXX, including XXXX discrimination against myself ( the only Latino-American in the group ) and another XXXX student from XXXX. Trainers themselves engaged in discriminatory remarks and inappropriate jokes. This was ignored entirely by Ascent in their response. Meanwhile, Ascent continues to send billing statements and repayment schedules ( see attached evidence ) and continues to call me and my co-signer despite written notice not to. This is a direct violation of federal law while the dispute remains unresolved. Respectfully, I remind the CFPB of its essential role : to protect consumers, not to merely forward messages between parties. A complaint process should involve ensuring that companies provide evidence, demonstrate due diligence, and comply with the law. Simply closing a case based on the companys unsubstantiated statements is not sufficient consumer protection. Information I have requested from Ascent Funding ( and which has not been provided ) : What objective evidence supports their statement that my training was adequate. What due diligence or investigation process was conducted before rejecting my complaint. Why my previously submitted evidence ( including the HR letter, proof of job applications, proof of discrimination ) was ignored. How they justify continuing billing and collection calls during an open dispute, despite written notice to stop. Respectfully, I request : XXXXThat Ascent be required to provide actual evidence, not assumptions based on other students. XXXXThat the CFPB review XXXX and misleading practices at XXXX connected to loans funded by Ascent. XXXXThat consideration be given to releasing my co-signer from liability, since the program was discriminatory, misleading, and failed to deliver the promised services. I am providing new evidence : call logs from XX/XX/year>, showing collection calls, billing emails showing continued repayment demands, and prior documentation of insufficient training and discrimination.
