I am submitting this complaint regarding Rubin & Rothman , LLC, acting on behalf of Bank XXXX XXXX, XXXX, in connection with an alleged debt. On or about XX/XX/year>, I received a Stipulation of Settlement and related correspondence from Rubin & Rothman , LLC. The documents state that I allegedly owe {$16000.00} and propose that I pay the creditor {$100.00} on XX/XX/year>, {$100.00} on XX/XX/year>, and {$100.00} on the XXXX of each subsequent month until the balance is paid in full. The stipulation also contains waiver provisions that would force me to give up defenses, including protections under state and federal law. The problem is that I am on Social Security, and as the documents themselves acknowledge ( in compliance with New York regulations ), Social Security income and other protected sources can not be garnished or taken to pay a debt. I have been paying this alleged debt for years using my Social Security funds, but based on these disclosures, I now understand that these funds are legally exempt. I do not wish to waive my rights, and I believe this collector is improperly pressuring me to continue payments with exempt funds. In XX/XX/year>, I filed a complaint with the New York XXXX Department XXXX XXXX XXXX ( NYSDFS ) ( case number XXXX ) regarding this matter. I was informed that the collector never responded to XXXX. I was further advised by XXXX to contact the CFPB. What I need clarified and resolved : Whether, under federal and state law, I am correct that this debt is not collectible from me because I am solely on Social Security. XXXX XXXX XXXX XXXX, LLCs communications and stipulation violate federal consumer financial protection laws by attempting to collect from exempt income and by requiring me to waive legal protections. XXXX Bank XXXX XXXX, XXXX. and its counsel XXXX continue to pursue this alleged debt given these circumstances. I am seeking confirmation from the CFPB that I should not be paying this debt with my Social Security benefits, and I ask that CFPB require the company to cease further collection efforts and correct their practices. It is bad enough that I have already been paying for years from exempt Social Security funds, and I need assurance that this will not continue.
