Consumer Narrative

On XX/XX/XXXX, my former insurance company attempted to automatically renew my policy and charged my Bank of America checking account in the amount of {$1900.00}. At the time, I only had about {$900.00} in my account, which immediately caused my balance to show negative by almost {$1000.00}. As soon as I saw the pending transaction, I called Bank of America to stop the payment. I was told by a representative that the transaction would fall off in a few days, and I would not be liable. To prevent my account from staying negative, I immediately transferred additional money into my account. However, a few days later, instead of disappearing as I had been told, the charge posted to my account as a completed transaction. I contacted Bank of America again, disputed the charge, and also requested a new debit card to prevent further unauthorized charges. Since then, it has been over a month. During this time, I provided Bank of America with documentation, including a letter from the insurance company confirming that the funds were charged back to me and that they never received the money. Despite this evidence, Bank of America has not resolved the dispute. Each time XXXX contact customer service, I am told to wait longer or that another request will be sent, but no clear resolution or refund has been provided. This situation has caused significant financial stress. I have followed all proper steps : I reported the charge immediately, disputed it formally, and even provided proof from the merchant that the funds were not collected. Despite this, Bank of America has withheld my funds for over a month and has not given me any concrete explanation or resolution. I am requesting the regulators assistance to XXXX Bank of America to : XXXX. Immediately credit back the {$1900.00} that was wrongfully held, XXXX. Provide a clear explanation of why the dispute has been delayed despite the supporting evidence, and XXXX. Ensure better handling of dispute investigations in the future. I believe Bank of America has failed in its responsibility to protect consumers from unauthorized or improper charges, and I am asking for regulatory review and intervention to resolve this matter.
