Consumer Narrative

Bank of America has repeatedly withdrawn money from my PERSONAL checking account ( ending XXXX ) without my authorization and applied it toward a BUSINESS credit card ( ending XXXX ). These transactions were labeled as offset payments. The offsets include : - XX/XX/XXXX {$320.00} - XX/XX/XXXX {$1300.00} - XX/XX/XXXX {$660.00} - XX/XX/XXXX {$310.00} - XX/XX/XXXX ( pending ) {$630.00} Total : {$3200.00} improperly taken. I never authorized Bank of America to debit my personal deposit account to pay this business card. No written authorization exists, which violates the * * Electronic Funds Transfer Act ( 15 U.S.C. 1693e ) and Regulation E. * * If Bank of America claims these were setoffs, they have failed to produce any signed personal guaranty or agreement that allows them to take funds from my personal checking for a business debt. Without contractual authority and mutuality, this setoff is improper. I requested documentation from Bank of America ( deposit agreement section, business card agreement, and any guaranty ) and they have not provided it.
