REBUTTAL TO ROCKET MORTGAGE RESPONSE CFPB Complaint ID XXXX Date : XX/XX/XXXX To : Consumer Financial Protection Bureau Consumer Response & Compliance Unit RE : Rocket Mortgage CFPB Complaint ID XXXX I, XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX ( Revocable Living Trust ) , respectfully submit this rebuttal in response to the XX/XX/XXXX letter issued by Rocket Mortgage , LLC, regarding the mortgage loan associated with ( personal address ), City, Texas XXXX XXXX XXXX XXXX XXXX and referenced under Loan No. XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXRocket Mortgages response fails to address the core of the dispute, which is the demand for lawful debt validation and full accounting in accordance with federal statutes, including the Fair Debt Collection Practices Act ( FDCPA ), the Truth in Lending Act ( TILA ), and relevant sections of the U.S. Code. Their dismissal of my claims as 'irrelevant ' and 'duplicative ' disregards the legal obligations of a mortgage servicer when proper dispute and redemption processes are invoked. As stated in prior notices and documented submissions, including my certified debt validation letter dated XX/XX/XXXX, the Trust is not refusing payment but demanding proper validation, lawful accounting, and a correction of securitization-related records. I have independently filed IRS Forms 1099-A and 1099-B showing that the mortgage was monetized and securitized under XXXX XXXXXXXX. This establishes that the debt was converted into a publicly traded security, and therefore, the principal obligation was satisfied or discharged through financial instruments, as recognized under applicable federal law and UCC provisions. Rocket Mortgages reference to a promissory note signed on XX/XX/XXXX, does not override my rights under lawful money redemption ( 12 U.S.C. 411 ), nor does it negate the Trust 's right to dispute any presentment under the Uniform Commercial Code. Their claim that only 'cash, check, or money order ' are acceptable forms of repayment contradicts established rights under federal monetary law and creates an artificial barrier to lawful settlement. Furthermore, the mortgage servicers failure to provide W-9 forms, proof of holder-in-due-course status, and a full chain of title with endorsements remains a material omission and a violation of FDCPA 809 and Texas Finance Code 392.202. Rocket Mortgage 's own documents, such as the Uniform Residential Loan Application and Closing Disclosure, do not constitute validation of an active, enforceable debt absent evidence that the note was not sold, securitized, or discharged. I reiterate the Trust 's demand that all foreclosure activities cease immediately, that Rocket Mortgage be ordered to respond in full to the debt validation and redemption notices, and that all unauthorized reporting or collection actions be halted pending full regulatory review. I respectfully request the CFPBs continued attention to this matter, and I reserve all rights to pursue legal and administrative remedies should these violations continue. I am also submitting this rebuttal as a supplement to the complaint file. Respectfully submitted, XXXX XXXX XXXX XXXX, XXXX XXXX ( Revocable Living Trust )
