Consumer Narrative
Subject : Formal Complaint Against Bank of America for FCRA Violations and Failure to Validate Alleged Debt Account ending in XXXX I am filing a formal complaint against Bank of America for continuously reporting a charge-off account to Equifax and TransUnion despite repeated failures to validate or verify the alleged debt, in clear violation of the Fair Credit Reporting Act ( XXXX ), specifically XXXX ( a ) ( XXXX ), XXXX ( b ), and XXXX ( a ). Despite multiple requests, Bank of America has not provided any of the following required documentation : Chain of title/ownership Complete payment history Original signed contract or agreement Any substantiating documentation to support the amount and legitimacy of the charge-off Instead of complying, they sent generic, one-page form letters containing nothing more than the boilerplate statement : This is an attempt to collect a debt. This does not satisfy the legal requirement for debt validation and constitutes further violation of the law. On top of this, I submitted a formal direct dispute under FCRA XXXX ( a ) ( XXXX ) demanding proper investigation and deletion of the account. To date, Bank of America has failed to provide : A written, substantive response Any form of supporting documentation Proof of a reasonable investigation under FCRA Yet, Bank of America continues to furnish the same unverifiable and likely inaccurate data to Equifax and TransUnion, knowingly causing continued harm to my credit profile. I also previously issued a XXXX notice to Bank of America via official email, clearly requesting validation and cease-and-desist ( Fri, XX/XX/year>, XXXX ) regarding this account. No action was taken. I am attaching that email chain as evidence. Furthermore, I explicitly requested that Bank of America cease communication and delete the account this request has also been ignored. Since my last dispute, Bank of America has sent me XXXX nearly identical one-page letters ( dated XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/year> ), each stating the same unverified language and providing no actual documentation or investigation outcome. This pattern of noncompliance violates : FCRA XXXX ( a ) ( XXXX ) Failure to conduct a reasonable investigation of a direct dispute FCRA XXXX ( b ) Continued reporting of inaccurate information after notification FCRA XXXX ( a ) Furnishing information without ensuring accuracy and verifiability Requested Resolution : Under these violations, Bank of America is obligated to permanently delete this account from all credit reporting agencies, including Equifax and TransUnion. Furthermore, I request that Bank of America respond directly and exclusively to the CFPB only.
