Consumer Narrative
On or before XX/XX/year>, I disputed an alleged debt and submitted a formal cease-and-desist and debt verification request to Synchrony Bank under 15 U.S.C . 1692g ( b ) and 1692c ( c ). I clearly stated that no further contact was permitted unless the debt was properly validated. Despite this lawful request, Synchrony Bank failed to provide validation of the alleged debt and instead continued to contact me, including sending three separate letters on XX/XX/year>, all postmarked the same day with varying postage and originating from the same address. These actions were taken after my cease-and-desist notice and dispute, which makes them unlawful and retaliatory. Synchrony Bank has admitted via a prior CFPB response that they received my cease-and-desist letter and statutory damages invoice. Despite this confirmation, they have failed to take corrective action, offer payment, or cease communication a willful act of noncompliance. I have now invoiced them for {$4000.00} in statutory damages, based on repeated and escalating violations of federal and state law. This behavior violates the following laws : 15 U.S.C. 1692c ( c ) Continued contact after written request to cease 15 U.S.C. 1692g ( b ) Continued collection efforts without debt validation 15 U.S.C. 1692e ( 5 ) and ( 10 ) False or deceptive collection conduct Minnesota Stat. 332.37 ( 12 ) Harassment by collection agency Minnesota Stat. 325F.69 Deceptive or unfair business practices I am requesting that the CFPB : 1. Investigate Synchrony Banks conduct, 2. Compel them to cease all further contact, 3. Confirm that the debt is unvalidated and unenforceable, 4. Prompt a response to the statutory damages demand I have submitted in writing. This is not a duplicate complaint. The company has engaged in new and escalating contact after my prior CFPB submission, specifically on XX/XX/year>, in violation of existing law. These mailings constitute fresh violations and are submitted now as separate, documented acts of harassment that warrant additional regulatory enforcement. I submitted all this with no third party representation and I speak like this because I have the ability to do as such. This is a brand new complaint after receiving three pieces of mail upon finding evidence Ive uploaded on to this complaint.
