In XX/XX/2022, I lawfully tendered a negotiable instrument to USAA Federal Savings Bank ( FSB ) in good faith as full settlement and discharge of the alleged debt on my Visa credit card account ending in XXXX. Under the Uniform Commercial Code ( UCC 3-603 ( b ), 3-104 ( a ), and 3-311 ), when a valid negotiable instrument is tendered and refused, the obligation is discharged to the extent of the tender. Despite my lawful tender, USAA FSB refused to accept or process the negotiable instrument, continued to report the account as delinquent, and charged it off. Their refusal violates UCC provisions, public policy, and the Fair Credit Reporting Act ( FCRA ), which requires accurate credit reporting. By refusing my lawful payment, USAA FSB has unlawfully continued collection efforts and reported inaccurate, damaging information to consumer reporting agencies.
