I am filing a formal complaint regarding an outdated debt that is still being reported through ChexSystems by XXXX XXXX XXXX XXXX, despite being removed from all three major credit bureaus ( XXXX XXXX XXXX XXXX ). Background : I recently attempted to open a checking/debit account with XXXX XXXX XXXX XXXX XXXX During the process, I was denied and informed that I was flagged in ChexSystems due to an old auto loan account with XXXX. This debt is over XXXX XXXX XXXX, and it has already been removed from XXXX XXXX and XXXX as required by law. However, ChexSystems is still reporting it, which is directly hindering my ability to access basic financial services. Violations and Concerns : XXXX. FCRA 605 ( a ) Reporting Time Limit The Fair Credit Reporting Act clearly states that negative information such as charge-offs or collection accounts can not be reported longer than 7 years from the date of first delinquency. Reporting this debt through ChexSystems is a violation of federal law. XXXX. Continued Harm After Deletion from Credit Bureaus Since the debt was properly removed from all three major credit bureaus, it should not continue to appear in any consumer reporting agency, including ChexSystems. Its continued presence is unjust and damaging. XXXX. Improper Use of Outdated Information XXXX XXXX XXXX XXXX is using this outdated and already-deleted debt to deny me banking services, which is both unethical and unlawful under the FCRA. XXXX. No Notice of Continued Reporting I received no proper notification that this debt would continue to be reported through ChexSystems after its deletion elsewhere, nor was I given a chance to dispute it with ChexSystems in a timely and fair manner.
