To Whom It May Concern, My name is XXXX XXXX. I am submitting this formal complaint in follow-up to the complaint filed on XX/XX/year>, under reference number XXXX. The company involved has failed to take corrective action to remove inaccurate and unlawful information from my credit report, in direct violation of federal law. The creditor in question has reported an account as paid and closed, yet continues to reopen and reclose the account without cause, which constitutes false and misleading reporting. This is in violation of the Fair Credit Reporting Act ( FCRA ), specifically : 15 U.S. Code 1681s-2 ( a ) ( 1 ) ( A ) Furnishers of information must not report information that is known or should be known to be inaccurate. 15 U.S. Code 1681i Consumer reporting agencies must conduct a reasonable investigation of disputed information and correct or delete inaccurate data within 30 days. 15 U.S. Code 1666b Requires accurate and timely crediting of payments and treatment of account activity. Additionally, I was verbally informed by the creditor that if I transferred the account from my personal name to my XXXX, the inaccurate tradeline would be removed. This account was originally intended to be under my XXXX at the time of contract signing, as the property associated with the account is owned by the XXXXnot me personally. Despite following the creditors directive and taking corrective steps, the inaccurate information has not been removed. This amounts to misrepresentation and deceptive trade practices, potentially violating : 15 U.S. Code 1692e ( 10 ) Under the Fair Debt Collection Practices Act ( FDCPA ), the use of any false representation or deceptive means to collect or attempt to collect any debt is prohibited. 15 U.S. Code 45 Under the Federal Trade Commission Act, unfair or deceptive acts or practices in or affecting commerce are unlawful. This creditors actions have caused significant and ongoing harm to my personal credit profile and financial standing. I am demanding the immediate removal of the inaccurate and unlawful information from all consumer reporting agencies. Failure to comply will result in legal action being pursued to seek remedies under all applicable federal consumer protection statutes.
