Consumer Narrative
I have repeatedly disputed an alleged debt reported and pursued by Portfolio Recovery Associates , LLC. Despite multiple written requests for proper debt validation under the Fair Debt Collection Practices Act ( 15 U.S.C. 1692g ), they have failed to provide legally sufficient documentationonly sending generic billing statements and, most recently, a copy of my own dispute letter as their " response. '' They continue to report the account to the credit bureaus without marking it as disputed, in violation of 15 U.S.C. 1692e ( 8 ), and have not verified the accuracy of the information per 15 U.S.C. 1681s-2 of the Fair Credit Reporting Act ( FCRA ). I believe this account may also be invalid due to prior discharge or improper assignment. I am requesting that the CFPB intervene to compel Portfolio Recovery Associates to cease all collection activities and credit reporting on this account until proper validation is provided, or to remove it entirely if validation can not be produced. To Whom It May Concern, This letter is in reference to my original written dispute dated XXXX XXXX XXXX XXXX in which Portfolio Recovery Associates ( PRA ) simply repeated your original letter back to me, rather than providing a legitimate response or the required validation. This is a common tactic used to stall or confuse consumersbut it does not satisfy their legal obligation under the Fair Debt Collection Practices Act ( FDCPA ) or Fair Credit Reporting Act ( FCRA ). I clearly and lawfully requested full debt validation under 15 U.S.C. 1692g of the Fair Debt Collection Practices Act ( FDCPA ). Instead of a proper response, your office merely returned a copy of my own letterwhich neither addresses the dispute nor satisfies your legal requirements. Let me reiterate : I continue to dispute this alleged debt. You have failed to provide any proper debt validation, such as : o A copy of the original signed contract o Full itemization of the debt o Proof of legal ownership or assignment o Flow Agreement o Transfer of Assignment Bill o Has Debt been Securitized If You have failed to mark this account as disputed with the credit reporting agencies, violating 15 U.S.C. 1692e ( 8 ). You are continuing to report inaccurate and unverified information in violation of 15 U.S.C. 1681s-2 of the FCRA. If this account remains on my credit report or if I continue to receive collection notices without lawful validation, I will proceed with the following actions : 1. File formal complaints with the FTC, CFPB, and Pennsylvania Attorney Generals Office 2. Seek damages and injunctive relief under 15 U.S.C. 1692k 3. Retain legal counsel to pursue appropriate remedies in court You are hereby notified again to : Cease and desist all collection activities immediately Cease reporting this debt until it is properly validated Provide the legally required documentation within 15 calendar days from the date of this letter Failure to comply will be viewed as continued, willful noncompliance and may result in legal consequences. Sincerely, XXXX XXXX XXXX
