When I took out the mortgage I negotiating a 5 % cap on interest. At closing the selling agent was in another state but was on the phone walking me through the documents that showed that 5 % cap. Im being charged 7 % and the company is using another paragraph to justify their position. My two documents were supposed to over ride that paragraph. They completely ignore my docs and try to make them seem to say something they do not, if they are correct and im wrong then im a victim of predatory financing because I was assured numerous times through the loan process I would have a 5 percent cap. My document states 5 % libor and the othe states 5 % fixed.
