Consumer Narrative

I am disputing a charge for carpet replacement that my former landlord referred to a debt collection agency immediately upon notifying me of the charge on XX/XX/year> ( 5 days after our lease end date ), without giving me a reasonable opportunity to dispute it directly. The landlord sent an email with a final account statement and photos of the unit on XX/XX/year>, but did not provide detailed documentation justifying the charge, such as the carpets age, proof that cleaning was attempted before replacement, or depreciation calculations. I requested this information on XX/XX/year> and, after response from the landlord which did not provide the information requested, again on XX/XX/year>. When I contacted the collections agency ( Assurant Recovery Solutions ) on XX/XX/year> to request a letter of debt validation, they stated the letter would only provide the same limited information already shown in the landlords final statement : a general reference to damage/carpet replacement and the amount owed. I submitted a written dispute to Assurant on XX/XX/year>. However, I remain concerned that this debt was referred to collections prematurely, without appropriate documentation or the opportunity to resolve the issue with the landlord directly. Im requesting CFPB review whether the debt collector and/or landlord followed proper procedure under the Fair Debt Collection Practices Act ( FDCPA ) and Washington State landlord-tenant law.
