On or about XX/XX/XXXX, XXXX XXXX XXXX, XXXX executed a Deed of Trust in favor of Prosperity Bank, securing a loan of {$500000.00} against three pieces of Real Estate in XXXX and XXXX Counties. While the Deed of Trust was recorded in XXXX XXXX on XX/XX/XXXX, it was only recently recorded in XXXX XXXX. On XX/XX/XXXX, I sold property on Lot XXXX, XXXX XXXX, XXXX XXXX, XXXX XXXX, to XXXX XXXX and XXXX XXXX for {$280000.00}. Before the sale took place, I proactively reached out to Prosperity Bank via email on ( XX/XX/XXXX ), requesting the release of the lien and an updated balance. These emails were ignored, and no action was taken by your institution. As a result, the sale proceeded without obtaining the necessary lien release. As a direct consequence of Prosperity Banks failure to respond to my requests, I was facing significant financial distress, including the threat of foreclosure on two of my properties. Furthermore, an important business transaction, that was scheduled to close on XX/XX/XXXX, was at risk because I was unable to access the necessary funds from my line of credit due to unresolved lien issues. XXXX XXXX bullied us into paying down significant amount of money and threatened us to foreclose on our properties. I was in a very significant business purchase at the moment when prosperity bank decided to pull the rug from under our foot and put us in a very stressful situation. I had to take a personal loan from my family member to close on the business transaction and also pay down prosperity bank. This also caused us to loose reputation in business relationships. I am still not able recover from the financial loss. The failure to act on my requests has placed me and my family in an untenable position, and I believe this situation could have been avoided had Prosperity Bank acted responsibly and in a timely manner. I request that you immediately review the circumstances and take the necessary actions to rectify this oversight. Prosperity Bank filed a lender title insurance policy claim but did not disclose the $ $ they recovered from the claim if any. In this case they double dipped and recovered money from us and also insurance company. They are also charging me {$130.00} a month for something that is not disclosed and I have reached out to them to ask for a disclosure and the emails are being ignored again.
