Due to XXXX, I had fallen behind on my mortgage payments. I first receive help from the XXXX program. During XXXX, I started addressing health issues which didnt get diagnosed until XX/XX/XXXX at which time I applied for XXXX. I did not get approved for XXXX until XX/XX/XXXX so during that time I had fallen behind on my mortgage again due to lack of income. When I was approved in XX/XX/XXXX, I got my mortgage account caught up made XXXX and XXXX payment and reached out to U.S. Bank and said look on a fixed income. My current payment is not sustainable. What are my options? They informed me they could do a loan modification. They approved me for a 40 year loan same interest rate with a balloon payment at the end thereby reducing my monthly payment. Before this could take place I had to do for trial payments of {$1500.00} per month. They started my trial payments in XXXX even though the full XXXX payment of {$1900.00} had been made in XXXX. So now requiring two payments from me for the month of XXXX drained what little I had as a savings cushion. I made the XXXX trial payments finish making the XXXX in XXXX trying to expedite my loan modification. I received the new loan modifications on XX/XX/XXXX. I signed them and returned them on XX/XX/XXXX with the new XX/XX/XXXX payment amount of {$1400.00}. I called following up with them each week to see if theres anything else they need from me making sure they initially received. They said all my paperwork was an order and the system would update by the end of XXXX. No system update. I continue to call multiple times per week to follow up on the status. This continued for XXXX phone calls in total Through yesterday XX/XX/XXXX. I started reaching out to them in XXXX asking look when are you gon na get my payment anpplied and your system updated Im concerned that the 1098 interest statement will not be correct. They assured me that all of this will take place and dont worry my 1098 would be correct it is not correct. They do not show all the interest Ive paid. They only have me paid through XXXX. This has been an ongoing battle, trying to get them to do their job. I kept reaching out asking them. When am I going to get a copy of my executed loan modification? If I did not take pictures of the documents, I would have no copy of it at all. They were not providing the copy of my executed loan modification nor of the payment breakdown that Ive been requesting. I also requested they correct my credit bureau because they are reporting incorrect information. They reported in XXXX that I was on a partial payment agreement even though the XXXX payment had already been made. It dropped my score XXXX points Instantly the day they put the comment on my credit report and at the very least the comment and the payment should have been updated after I signed the modification documents instead, the dispute I filed with the credit bureau in XXXX. They contested it and provided the same information and I recently filed disputes with all the credit bureau agencies providing a copy of my loan modification a copy of my payment history from the bank and all US bank. It is between XX/XX/XXXX and XX/XX/XXXX. The comment that I was still on a partial payment agreement and the payment was {$1500.00} is how they responded to my dispute When I spoke with U.S. Bank on XX/XX/XXXX, still again requesting the system updates requesting a copy of my executed loan modification also requesting a copy of my payment breakdown. I told them Im sure they have violated my CFPB rights not providing me a copy of my executed documents. Here it is XXXX months later and I have no copy of my executive document. Well, I get an email to the secure portal XXXX where they have uploaded a document and there was the copy of my executed loan modification. They executed it on XX/XX/XXXX. On XX/XX/XXXX they decide to issue new loan modification document backdated with a different payment starting date and the principal balance being the same balance as it was in XXXX. XXXX from Customer advocacy called me on XX/XX/XXXX to tell me he sent me new loan modification documents and then I should be getting them shortly and I said I dont understand why I have to sign new documents. I have an executed copy which is a legally binding document he really couldnt give me an explanation. To date, I have filed XXXX internal complaints with U.S. Bank XXXX drafted a letter on the XXXX which I dont believe is ever mailed to me. I only found out on XX/XX/XXXX that this letter existed of which they sent to my email the letter says theres an enclosure of the payment breakdown and that their comment had no negative impact on my credit which is not true, but there were no enclosures with the letter whatsoever. I received the new loan modification documents on XX/XX/XXXX and looking at them was serious concerns that they are backdated. Theyre starting a month later than the original document and the principal balance is still the same as it was in XXXX. My question is I said to US Bank on the phone what happened to almost {$17000.00} in payments Ive made in XXXX? Their responses oh, dont worry about that. Itll get fixed when the system updates. Im like oh my goodness Ive been hearing your system is gon na update for XXXX months now. I told them everything youve told me to date is a lie. I feel US Bank has violated my RESPA rights. They signed an executed the first modification, which I felt was a legally binding document between myself and the bank not only that theyve had undo delays in processing the original modification. Theyve had undo delays and applying my payments. Undo delays in getting me a copy of my executed document and now they want me to sign new documents. Today being the deadline for them to receive the new modification documents, I was informed on XX/XX/XXXX that if they did not receive them by this Saturday, my loan will revert back to the original $ 1991 monthly payment. This whole process U.S. Bank in their negligence in processing my modification and getting me my copies of the document, and applying my payments correctly has caused me severe stress. I told them yesterday I feel like Im signing these new documents under duress and I wanted that noted. Since XXXX Ive been getting treated for an XXXX I had to have a XXXX of my XXXX had to go through a XXXX XXXX because of the XXXX XXXX XXXX XXXX since early XXXX I had to see my doctor on XXXX XX/XX/XXXX, because the XXXX in my XXXX has gotten worse not better of which now he is referred me to a XXXX he said maybe they need to more XXXX XXXX to get to the bottom. I told him its the stress with my mortgage company that all this XXXX XXXX and the XXXX XXXX started in early XXXX. And because of the XXXX XXXX and theyre treating me as if its an XXXX, I have to now get an XXXX. Yesterday I really felt severe mental, emotional and physical anguish from all this stress. I actually thought I was having a XXXX XXXX last night and were sitting here trying to breathe because the XXXX in my XXXX was so bad and the XXXX XXXX XXXX, which now is shows outside in my hands, the constant crying this has just been overwhelming and feels like more than I can take. I couldnt afford to go to the ER because of all the co-pays I have to pay even though Im on XXXX. I feel like US Bank should be sued for everything that they have put me through. I know they have had to violated not one but many of my rights. As of yet I still have not been told what the total interest I will have paid by the end of the XXXX years. I feel like thats a violation of federal truth and lending act.
