Consumer Narrative
XXXX USAA Visa Rewards card I am filing a complaint against XXXX for failing to properly investigate my dispute, violating my rights under the Fair Credit Reporting Act ( FCRA ), and reporting misleading information that has damaged my credit. Failure to Conduct a Proper Investigation I submitted a dispute to XXXX regarding an inaccurate account on my credit report. XXXX illegally refused to investigate my dispute unless I provided a police report, which is not required under the FCRA for a standard dispute. Under FCRA 611 ( 15 U.S.C. 1681i ), XXXX is required to conduct a reasonable investigation within 30 days and provide a method of verification ( MOV ) upon request. They failed to do so. Failure to Verify Disputed Information XXXX did not provide me with any legally binding proof that I am responsible for the disputed account. They refused to produce any signed contract or original documentation, violating FCRA 611 ( a ) ( 5 ) ( A ), which requires them to delete information if it can not be verified. Misleading and Harmful Credit Reporting I continue to receive electronic messages stating that a closed and charged-off credit card is over its maximum limit. This misleading alert, sent to XXXX XXXX XXXX, American Express My Credit Card, and XXXX XXXX XXXX, falsely inflates my credit utilization, which damages my XXXX Score. Under FCRA 607 ( b ) ( 15 U.S.C. 1681e ( b ) ), XXXX must ensure maximum possible accuracy in reporting, yet they continue to report misleading information. Unfair Stall Tactics I live outside the U.S., making it difficult to file a police report, which XXXX knows. XXXX is using this as a deliberate stall tactic to avoid correcting the errors in my credit report, violating my rights under the FCRA.
