MOHELA is involved in Racketeering, financial fraud, and Unfair Debt Collection Practices and needs to have enforcement actions taken against their criminal enterprise. MOHELA engaged in interstate wire fraud to promote their scheme and despite having been ordered to CEASE and DESIST from all calls they have continued in XXXX violations of the Federal Do Not Call List, each violation carrying a {$1000.00} penalty. MOHELA failed to pay the published fee schedule for the XXXX copyright uses, each use is {$500000.00}. XXXX uses. {>= $1,000,000}. Plus the prior XXXX Federal Do Not Call list violations at {$1000.00} per occurrence is {$6000.00}. XXXX had been served prior NOTICE that there was no Debt. The US Treasury confirmed that we owed no money to any government agency. XXXX also engaged in financial fraud in not providing coupons until CFPB began enforcement action against XXXX. XXXX had contracted to have no other servicer as a condition of original contract, which was also done in fraud by XXXX failing to disclose that XXXX had not provided the year for year federal reduction in loans for each year of authentic non profit service. We had served for XXXX years indicating that that the XXXX years of Non Profit service satisfied the requirements. Further, Full Settlement was Tendered and per UCC 3-603 any Debt was Discharged. The outcome of CFPB enforcement action was the dissolution of NAVIENT and hefty fines of {$120.00} XXXX levied in XXXX by CFPB. XXXX never paid us for their fraud. Instead, they conspired with MOHELA to continue the ruse. MOHELA indicated that it was the new loan servicer. We requested Proof of Contract, Proof of Debt. MOHELA refused to provide original documentation. MOHELA began a series of calls despite our having informed them of their obligation to provide Proof Of Contract and Proof of Debt, the US Treasury having already determined there was no Debt. On the first call we informed MOHELA to CEASE and DESIST and we owed them nothing and we owe XXXX nothing. MOHELA continued their harassment of an elderly XXXX veteran despite our express instructions to CEASE AND DESIST and informing them that they had violated Copyright Use without our consent. We informed MOHELA that the Executor Office was Occupied and that they were incurring additional liability under trust law and under Unfair Debt Collection Practices. Despite our complaint to CFPB, MOHELA incorrectly stated that they were authorized by the federal government to call us. This was a false statement as they are a private company and are bound by federal code concerning Debt Collection. MOHELA misrepresented itself and made false statements to CFPB when MOHELA stated that they were not trying to collect a Debt, they were trying to service a loan. This is false. We have no contract with Mohela, and XXXX was done in fraud as shown by their current status. XXXX has never paid us for the use of our property, our signature in financial matters. MOHELA has failed to provide proof of contract, proof of debt. We then instructed MOHELA to process IRS Form 1099C for any alleged debt as that is TENDER for full settlement, however, MOHELA dishonored the Tender and thereby under UCC 3-603 any alleged debt with MOHELA was immediately discharged. We maintain that there was no Debt. MOHELA lied to CFPB because XXXX notified us a week ago that there was an adverse event, DELINQUENT on our credit report. We did not check the credit report as we are not DELINQUENT in any matter. On about XX/XX/XXXX, MOHELA called a XXXX time despite the record having been annotated DO NOT CALL, FEDERAL DO NOT CALL LIST. The agent confirmed that MOHELA had XXXX days prior sent a DELINQUENT Notice to Credit Reporting agencies. By their admission, MOHELA engaged in false statements to a regulatory agency CPFB when they wrote in their prior response that MOHELA was not collecting a Debt. We can not tell which lie of MOHELA is true except that they are involved in RACKETEERING using WIRE and US MAIL to commit financial crimes against elderly. MOHELA Caller # XXXX was MOHELA agent who identified himself as one XXXX XXXX calling from ( XXXX ) XXXX on a recorded line from XXXX, Indiana and with ID XXXX. Said agent confirmed that MOHELA was a private company registered in Missouri. He confirmed in direction contradiction to what MOHELA stated to CFPB. The said agent confirmed that MOHELA does not work for the government. MOHELAs prior response to CFPB is that they collect federal student loans, which was a false statement concerning our matter. On a recorded line, we confirmed with XXXX XXXX that he is acting for MOHELA, his is an employee of MOHELA, that he is authorized to speak for MOHELA, and that he accepted all liability and waived immunity from prosecution speaking on behalf of MOHELA. We informed him that he and MOHELA owe us {$7000.00} for XXXX violations of the Federal Do not Call List, and XXXX copyright uses of {$500000.00} each per the published fee schedule on XXXX and that the Executor Office was occupied. We demanded that MOHELA pay us {>= $1,000,000} for the Copyright use and the XXXX violations. We demanded that MOHELA Cease and Desist, and restore our credit showing no Debt, No Deliquency, as MOHELA was involved in criminal racketeering activity using wire, mail, and lying to federal regulatory agencies in attempts to defraud people. We informed said agent that under the PINKERTON Doctrine, MOHELA had conspired in deprivation of rights under color of law, had furthered the XXXX criminal scheme and since the crimes had already been committed, anyone furthering the scheme would be held to the same level of liability/ penalty. All of the liability on XXXX now rests on MOHELA as co-conspirator involving XXXX organizations and no less than XXXX individuals to further the scheme. The said agent stated he was offering us the opportunity to work out a payment plan. We confirmed the our payment plan was this : MOHELA CEASE and DESIST, MOHELA Provide Proof of Contract, MOHELA pay us {>= $1,000,000}. On XX/XX/XXXX MOHELA caller agent # XXXX made a call to our number on the FEDERAL DO NOT CALL List, despite our having informed MOHELA to CEASE and DESIST and to annotate the notes in the record that they are in violation of the Federal Do Not Call List and owed us {$1.00} for their scheme, now with the XXXX caller, MOHELA owes us {>= $1,000,000}.
