My XXXX mother is not expected to live more than a few more days, so it is urgent that this be fixed to avoid probate. I am POA on her Bank of America accounts ( checking and savings ). I also have a comprehensive POA. She recently had a new trust drawn up naming me as co-trustee and stating that I full power over all accounts covered by the trust. I went to the branch in XXXX XXXX, NM to discuss what to do per this new trust to avoid probate and move the accounts into the trust as per attorney and trust instructions. I provided them my Durable POA, the Certificate of Trust and the Trust itself. The branch was very helpful and suggested the most efficient method was to make me a joint owner on the account so that it would pass directly to me upon her death. They proposed this electronically to Bank of America 's legal team, and they declined the request and refused to take action. At this point, Bank of America is refusing to acknowledge the trust, the direction of the trustee ( me ), and refusing to acknowledge the POA, despite the fact that I am listed in as POA on the account and provided all documentation. I am also the sole beneficiary of the trust as stated in the documentation.
