On XX/XX/XXXX, I received notice from Mandarich Law LLC regarding a debt I owed XXXX XXXX XXXX in the amount of {$1400.00}. XXXX purchased this debt from the XXXX XXXX XXXX where I had a credit card. I requested more information about the debt via email to XXXX at XXXX that evening from my personal XXXX To that, I received no written confirmation or response. However, on XX/XX/year> I received a letter from Mandarich Law showing me a credit card statement to the debt for a XXXX Credit Card that was authorized by the XXXX XXXX XXXX They claimed they could move forward with proceedings but wanted to hear from me first. I quickly wrote an email to Mandarich ( XXXX ) which is the primary email listed on the letter I received and is well advertised on their website. I acknowledged the debt, and offered to settle for {$1000.00} over 8 monthly payments. I received no response. Due to another recent legal issue I had, I have browsed a local court docket and noticed a lawsuit was filed ( statement of claim ) against me on the early morning hours of XX/XX/year>. It was seeking legal action that for the entire amount stating I had not responded or articulated interest in settling or communicating. Further, they took that step without # XXXX responding to my request and # XXXX showing that XXXX had actually purchased the debt from the XXXX XXXX XXXX ( only a credit card statement ). The law firm dated my letter validating the debt on XXXX XXXX, 2024 but I did not receive it until XXXX XXXX. The letter was not sent via certified mail nor with tracking information so there was no way of knowing I received it. I communicated immediately after receiving this message and I know they do receive my emails, because I finally received the validation 2 months after I requested it via email but did not get an acknowledgement. They did not account for the fact that they dated their letter on XX/XX/XXXX, but I didnt receive it timely and as a result they initiated legal action against me despite my ongoing efforts to resolve it. Once I came across the lawsuit yesterday, I emailed a letter to the counsel on file, XXXX ( the primary email of receipt for the suit ), and XXXX. I requested they accept my offer and make me a counter offer. Further, that they cease service of process and withdraw the statement of claim against me because I had made a documented effort to reach them in a timely manner after I received acknowledgement.
