Hello, XXXX was called at ( XXXX ) XXXX XXXX XXXX XX/XX/year>, and XXXX investigated and confirmed that there are no lates. XXXX further stated that they have NO correspondence from Experian, so Experian is dishonest and have acted in bad faith. She looked at the entire account has no credit bureau investigation. Experian has numerous times FAILED to provide documentation of late when I have recording of XXXX and XXXX confirming I have no lates. At XXXX XXXX XX/XX/year>, I escalated the matter with XXXX ( supervisor at XXXX ), who stated they're not showing anything about they're late and there is no documentation of any correspondence from Experian. Both Experian and XXXX have both been notified XXXX with a written request, with no cooperation, of the erroneous entry of XXXX reporting a XXXX late on my credit. In addition, XXXX was called XXXX times. XXXX XXXX XXXX was contacted XXXX XXXX XX/XX/year>, and she assured that my account is in perfect standing with no lates. XXXX XXXX XXXX was contacted XXXX XXXX XX/XX/year>, ALSO assured that my account is in perfect standing with no lates. I mentioned the concerns how this erroneous entry is adversely impacting my credit and that it's in direct violation of XXXX XXXX. Thus, XXXX and Experian have NOT provided me a copy of ANY original documentation required under Section 609 ( a ) ( 1 ) ( A ) & amp ; Section 611 ( a ) ( 1 ) ( A ) ( a consumer contract with my signature on it ) and under Section 611 ( 5 ) ( A ) of the FCRA so they are required by law to promptly DELETE all information which can not be verified.. The law is very clear as to the Civil liability and the remedy available to me for negligent noncompliance ( Section 617 ) if you fail to comply. I am a litigious consumer and fully intend on pursuing litigation in this matter to enforce my rights under the FCRA. Experian is in violation of Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681 et seq., which promotes accuracy, fairness, and the privacy of personal information assembled by Credit Reporting Agencies ( CRAs ) Please investigate and enforce the laws, rules, and regulations on both parties, please.
