Since XXXX XXXX XXXX Resurgent capitol services has sent me letters for an alleged debt that I do not owe and have responded to them with this letter : XX/XX/XXXX ( XXXX letter since XX/XX/XXXX ) XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX RE : Ref # XXXX Dear Sir/Mam, I received a letter on XX/XX/XXXX and dated XX/XX/XXXX ( XXXX XXXX XXXX regarding an alleged debt which I do not owe. I believe Resurgent Capitol Services is acting in bad faith, and have not complied with State and Federal Regulations i.e.. FCRA section 605, 611, [ 15 U.S.C.1681i, 1681g, 1681d and 1681e ] respectively. In addition to Section 311 of the FACT ACT. There is reasonable cause that the information is inaccurate FCRA 1681 by reporting three separate collections on my credit report however, the letter I received is referencing one balance of {$910.00}. In accordance with the Fair Debt Collection Practices Act, I am requesting all of the following information be provided to me by mail : 1. The official original amount of the alleged debt. 2. Official Confirmation of the full legal name and mailing address of the original creditor for this alleged debt. 3. Documentation Verifying that I am responsible for this debt. In addition, all application documentation including verifying that I signed such purported application as well as validation that I was the actual person who signed any purported application documents. 4. Documentation showing you are licensed to collect debts in the State of Virgina. Because I am writing to you within 30 days of being notified by your company about this alleged debt, you must cease attempting to collect this alleged debt until after you have provided the information I have requested, which are my federal rights under the Fair Debt Collection Practices Act and Fair Credit Reporting Act. As stated by FTC FCRA 616,617,621 if you do not comply, you may be sued by the FTC, consumer Financial Protection Bureau ( CFPB ), state governments, or in some cases, consumers. The FCRA provides for maximum penalties of {$4100.00} per violation in the case of lawsuits brought by the FTC. Comply with my written notifications ( XXXX time since XXXX XXXX ) stop violating my rights and comply as dictated by law and FTC regulations. ( Copy of FTC Regulations eclosed/attached ) If you continue attempting to collect on this debt without first providing written verification, which I have requested since XX/XX/XXXX, you will be in violation of the Fair Debt Collection Practices Act. If also continue to contact me without complying as dictated with above requests I will be well within my right to file a complaint with the ( CFPB ) Consumer Federal Protection Bureau.
