Please be advised that this is my 3rd WRITTEN REQUEST, before I pursue litigation in accordance with the FCRA to enforce my right and seek relief and recover all monetary damages that I may be entitled to under Section 616 and Section 617 regarding your continued willful and negligent noncompliance. Despite my previous 2 written requests, the unverified items listed below still remain on my credit report in violation of Federal Law. I am a victim of identity theft. I have alerts saying my information is compromised on the dark web. I've filed the proper reports and let all the consumer reporting agencies know of this matter. Experian is reporting inaccurate and incorrect information on my consumer report and has failed to follow federal laws and guidelines stated under FCRA Sec 605B ( 15 U.S.C 1681c-2 ) Section 605B of the Fair Credit Reporting Act ( FCRA ), which is codified at 15 USC 1681c-2 , contains provisions related to the blocking of information resulting from identity theft. Under Section 605B, if a consumer submits an identity theft report to a consumer reporting agency and requests a block on the reporting of information that resulted from the identity theft, the agency must comply with the request within four business days. Also, they failed to honor their responsibility under Sec 611 ( a ) of the Fair Credit Reporting act codified at 15 U.S.C 1681i ( a ) which requires consumer reporting agencies to " follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. Using e-OSCAR to process consumer disputes, does not satisfy the requirements of FCRA Section 611, which mandates a " reasonable reinvestigation '' of disputed information. As highlighted in cases like XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, courts have determined that CRAs can not solely rely on e-OSCAR 's automated processes to meet their obligations under the FCRA. These rulings emphasize that merely forwarding disputes to data furnishers via e-OSCAR without conducting an independent and thorough investigation is inadequate. The FCRA requires that CRAs take additional steps beyond the automated exchange to verify the accuracy of the disputed information, ensuring that consumer rights are fully protected. It has been well pass the 4 day time period and I immediately request this fraudulent accounts be deleted immediately. 15 U.S. Code 1681o - Civil liability for negligent noncompliance In general Any person who is negligent in failing to comply with any requirement imposed under this subchapter with respect to any consumer is liable for any actual damages sustained by the consumer as a result of the failure Negligent noncompliance means the law was violated not on purpose but just due to a lack of knowledge on the required reporting procedures. EXPERIAN have violated even more violations by failing to comply after my first initial CfPB complaint. I also added a fraudulent address to be removed which Experian denied because they stated it was attached to an undisputed account but that is false because I am disputing the account as well and is listed in my FTC report. This is further proof that Experian is violating the FCRA and my right under it. I have attached the email for review where it states it in the CFBP report for review.
