Complaint Regarding Failure to Remove Identity Theft Information from Credit Report Consumer is writing to file a formal complaint against the credit reporting agencies XXXX, XXXX XXXX Experian for failing to remove fraudulent information from consumers credit report, despite consumers repeated requests and compliance with all necessary procedures. On XX/XX/XXXX consumer discovered that they were a victim of identity theft. The fraudulent activities have severely impacted consumers credit report, and consumer has been diligently working to have these items removed. To this end, consumer filed an identity theft report with the Federal Trade Commission ( FTC ) on XX/XX/XXXX, and provided copies of this report, along with other supporting documentation, to the credit reporting agencies. Pursuant to 15 U.S.C. 1681c-2 ( the Fair Credit Reporting Act ), the CRAs are required to block the reporting of fraudulent information resulting from identity theft within four business days of receiving proof of the identity theft, a copy of the identity theft report, and an identification of the fraudulent items to be blocked. Despite meeting these requirements and making multiple requests, the credit reporting agencies have failed to comply with this legal obligation. The failure to remove this fraudulent information is not a matter of negligence or oversight but constitutes willful non-compliance with the FCRA. This deliberate disregard for federal law has caused significant and ongoing harm to consumers credit standing, financial well-being, and peace of mind.
