In XXXX we enter into XXXX XXXX bankruptcy. We were discharged in XXXX. In the final year of our XXXXXXXX XXXX Fay begin a series of errors that was promptly brought to their attention through Notices of Error letters. Errors such as inaccurate monthly statements, using pre-petition money paid through the Trustee to pay ongoing post-petition mortgage payments, inaccurate arrears balance, inaccurate amount paid during bankruptcy, principle reduction payments, and making payment changes without the court or the Trustee approval. In XXXX of XXXX Fay declared that we were more than {$11000.00} in post petition arrears because of the mistakes that they made in misusing per and post petition funds. We made every payment per statement. We would receive a statement in XXXX that was due until XXXX because of this misapplication. These errors jeopardized our bankruptcy discharge. The Judge, in order to give us the discharge we worked so hard and sacrificed so much for suggested that Fay Modify the pre-and post- petition debt and granted them relief from stay for the expressed purpose of communicating with us to modify the debt. On XX/XX/XXXX we entered a temporary modification with the promise of a permeant modification if we made all the payments. We made three payments before receiving a phone call in XXXX of XXXX from a XXXX XXXX from Fay Servicing informing we that we met all the requirement for the permanent modification and that the documents were being prepared and we should get them shortly. We never stopped making our payments. XXXX called later asking if we received the modification documents they sent. I told him no we didn't. He promised to re-send them. To this day we have not receive a permanent modification So we kept making our payments. Fay returned our XXXX payment stating that we were in default some {$40000.00}. We have spent over five years of our lives to get back on track and now because of Fay Servicing errors we are in no better shape than we were over five years ago. Even before the {$11000.00} in XXXX of XXXX Fay should have alerted us of 45 day delinquency. They did not. At our age, we just want to be treated fairly.
