During the course of the foreclosure proceedings, which are in dispute, the plaintiffs attorneys added defendants in error which created confusion and created the possibility for fraud. The Sheriffs documents, civil court documents and even the property records were affected by the error. This would not have happened if the additional defendants were not added in error. 1. Ominous, unspecific, fraud inducing names such as " XXXX XXXX have been added as defendants, in error. XXXX. Bayview Loan Servicing , LLC ( herein bayview ) was added as a defendant, in error. The attorney for bayview is the same attorney for the plaintiff, which is not only a conflict but it gives the attorney the potential to influence the case as both the plaintiff and the defendant!?! It also puts bayview in a conflict position when evaluating a loan modification or cooperating with a realtor. XXXX XXXX has no debt with Bayview Loan Servicing , LLC. XXXX. XXXX XXXX is very much alive and well. XXXX heirs, none of which are even close to the age of 18, is inappropriate. This practice was further compounded by someone trying to sow discord between XXXX XXXX and the children ( XXXX XXXX has shared custody ) by falsely suggesting to the children that XXXX XXXX is in some way trying to keep money from them. The only outcome of this action is forcing XXXX XXXX and the children into a housing crisis. Similar tactics were used with other family members.
