Consumer Narrative
This is regarding the behavior of A.R. Audit Services, INC. located at XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX. On XX/XX/XXXX I received a debt collection letter in the form of a legal summons through the regular XXXX mail. This was not sent via a process server of through certified mail. Previously this company has used Sheriff Deputies to serve similar fraudulent court documents. The entire document is written in the format and language of a legal summons or subpoena implying an active case in the XXXX XXXX XXXX XXXX XXXX XXXX. It is not written in plain English and has all the appearance of legal documents for an actual active lawsuit. There is no file or case number printed anywhere on the document and nothing has been filed in District court as claimed by the documents. At the bottom of each page of the document it states " This is an attempt to collect a debt .... '' The documents never mention " future legal actions '' and instead the document repeatedly misrepresents as actual legal documents to a current active legal proceeding by using terms such as " this lawsuit '' and making demands that their " ... interrogatories shall be answered under oath ... '' Many of the demanded interrogatories are for specific information the debt collector should already have in their possession and are required to provide in a certification of the debt. Many of the demanded interrogatories are intended to have ME validate the debt and admit to it being MY liability without them providing any of the information or documents that they are required to. Such a letter sent to the average individual would very likely illicit an admission of liability regarding the debt as well as allow them to collect and obtain the information they may be missing in their required records. Obtaining these from individuals by deceptive and intimidating practices. At no time has this company engaged in any form of communication or provided any documentation regarding the debt other than sending letters of this format. No itemized list of debts/charges. No certification of the debt. In all of the communications, there is no statement informing me that I can dispute the debt or how to do so. Also no where in the documents does it state how I can contact the company to discuss or dispute the alleged debts. The only contact information included is in the signature line on the second to last page of the document, which is unsigned by the listed attorneys of the company.
