Consumer Narrative
I am writing to file a complaint against XXXX XXXX and Credit Reporting Agencies ( CRAs ) XXXX, Equifax, and XXXX for violations of my consumer rights under the Fair Credit Reporting Act ( FCRA ). Specifically, these entities have breached the following federal laws : 15 USC 1681b ( 2 ) : Unauthorized access to my credit report. 15 USC 1681s-2 : Furnishing inaccurate information and failing to correct and update information. 15 USC 1681b ( 3 ) : Improper use of consumer reports for adverse actions without proper notification. 15 USC 1681a ( d ) 2 ( A ) ( i ) : Consumer reports do not include information solely about transactions or experiences between the consumer and the person making the report. Late payments and utilizations are considered transactions and experiences and should be deleted. Additionally, charge-off accounts should be excluded from my consumer report pursuant to IRS rules and guidelines, as they are considered ordinary income and income is not reported on consumer reports. These violations have negatively impacted my creditworthiness and financial stability. I urge the CFPB to investigate these infractions and ensure compliance with federal laws to protect consumers like myself. Additionally, credit scoring models like XXXX and XXXX are proprietary tools and algorithms used by lenders to assess creditworthiness and determine credit terms, but they are not factors outlined in the consumer report or governed by federal consumer protection laws, which take precedence over individual bank guidelines. I rely on the CFPB to enforce federal consumer protection laws and regulations ensuring the credit reporting practices, including those used by lenders adhere to established guidelines and do not override the protections afforded to consumers under federal law.
