In XXXX of XXXX Truist Bank stopped sending me my monthly statements. On XX/XX/XXXX I received a notice from Truist that my account was in default and I had 30 days to pay the due amount. If payment wasn't made then they it may become necessary to accelerate the full amount of the loan. On XXXX of XXXX, I received a Notice of Intention to Foreclose from Truist 's attorneys XXXX XXXX XXXX. I subsequently contacted their attorneys and they recommended I apply for loan modification. I contacted Truist Bank and requested an application for a loan modification. During my conservation with XXXX from their Loan Modification Department she didn't mention that if I was 120 days late with my payments that I would automatically ineligible for a loan modification. I applied for the loan modification in XX/XX/XXXX and 2 days later XXXX called me and verbally told me I was denied because I was more than 120 late with my payments. I asked her to send me the denial in writing with any loss mitigation options available to me. I was sent a denial but no written explanation or other loss mitigation options. I emailed their attorney requesting my monthly statements be sent to me as well as reinstatement amount and full amount owed on the loan. The attorney did not respond. I let my HUD counselor know that the attorney wasn't responding to me. My HUD counselor emailed their attorney asking for the items I requested and the attorney responded to him. The attorney subsequently sent me the reinstatement amount and the full amount owed in the loan but not my monthly statements. This is a violation of Regulation Z of Truth and Lending Act. Truist Bank told me that since they initiated foreclosure ( XX/XX/XXXX ) and turned my file over to their attorneys they can stop sending me monthly statements. They stopped sending me statements in XX/XX/XXXX.
