Consumer Narrative

Notice to agent is a notice to principal, and notice to principal is a notice to agent. Dear Scratch, I received your response to my dispute, and I am compelled to address the misconceptions and violations of the Fair Credit Reporting Act ( FCRA ) contained therein. Firstly, 15 U.S.C. 1681s-2 holds all furnishers of information, including loan servicers like Scratch, accountable for complying with the FCRA. This section imposes a duty on furnishers to ensure the accuracy and completeness of information reported to consumer reporting agencies. However, only creditors have the authority to furnish information, as stated in 15 U.S.C. 1681a ( f ), which defines a creditor as " a person who regularly extends, or other than as a creditor, regularly arranges for the extension of, credit. '' By furnishing information related to my student loan, Scratch has violated the FCRA in several ways : - Reporting inaccurate information ( 15 U.S.C. 1681e ) - Failing to obtain my permissible purpose ( 15 U.S.C. 1681b ) - Failing to provide clear and conspicuous disclosures ( 15 U.S.C. 1666b ) These violations have caused me significant harm, including : - Lost time and effort in disputing the inaccuracies - Denial of credit opportunities - Damage to my reputation and credit score Pursuant to 15 U.S.C. 1681n and 1681o, I will hold Scratch liable for these violations, including : - Statutory damages of {$1000.00} per violation ( 15 U.S.C. 1681n ) - Actual damages for harm caused by the violations - Punitive damages for Scratch 's willful noncompliance - Legal fees and costs associated with arbitration Furthermore, I enforce my rights to OPT-OUT pursuant to 15 U.S.C. 6801 and 6802, which supersedes any agreement between me and Scratch. The FCRA precedes any contractual obligations. 15 U.S.C. 6802 ( a ) states : " A consumer may elect to have a financial institution not disclose nonpublic personal information about the consumer to a nonaffiliated third party. '' This means I have the right to opt out of having my information shared with third parties, including Scratch. This opt-out right is a statutory right granted by the FCRA, which takes precedence over any contractual agreement between me and Scratch. I request that Scratch takes immediate action to correct the inaccuracies and provides evidence of compliance with the FCRA. You can either update the account to, " Paid as Agreed '' or delete the account from my consumer report as I OPTED OUT ( Pursuant to 15 U.S.C 6802 ) Failure to do so will result in arbitration, and I will seek all available remedies. Sincerely
