On XX/XX/2024 I closed on a {$25000.00} conventional refi loan with TD Bank. The nearest branch is over XXXX miles away from my residence, so I closed with a notary at my residence. Funds were to be disbursed XX/XX/2024 and mailed by the XXXX XXXX. On XX/XX/XXXX, tracking the package the package status was out for delivery and never was delivered. I called UPS that evening and the XXXX stated the package was lost. On XX/XX/XXXX I contacted TD Bank via email and phone to inform them of the lost package. Ever since XX/XX/XXXX there is XXXX XXXX of phone calls to TD Bank call center to reconcile the situation. All I requested of the bank and keep requesting is the check be cancelled and a new check be issued. Finally, on XX/XX/2024 an employee from the branch where our loan was closed spoke to me to say the check issued is a cashier 's check and according to federal law can not be cancelled until 90 days after issue if lost. A lost check, that I did not loose should not affect our contract. We were closed, I was to receive funds XX/XX/2024. It is almost 1 month later and my first payment will be due and I have not had funds from TD Bank as per contract. Please assist in this situation. The bank recommendation is to be patient, possibly wait 90 days and if our payment is due they will not require payment. That is not what our contract states, if you ask me they are in breach.
