Disputing Account # XXXX TO WHOM IT MAY CONCERN : I have reached out to REGIONAL FINANCE on multiple occasions regarding this erroneous debt and/or account reported to major credit bureaus as of XX/XX/XXXX. This account was opened fraudulently and Regional Finance has failed to provide proof of validation regarding a debt that does not belong to me. Furthermore Regional Finance has submitted this alleged debt on my consumer report and have failed to validate the alleged claim pursuant to Sec. 809 ( b ) of the Fair Debt Collection Practices Act and according 609 ( a ) ( 1 ) ( A ), you are required by federal law to verify, through the physical verification of the original signed consumer contract, any and all accounts that you post on a credit report. I demand this item be removed from my credit report immediately. REGIONAL FINANCE ; You are furnishing inaccurate and incorrect information to the consumer reporting agencies. The reporting of such inaccurate information has caused severe damage to my character, my reputation, my general mode of living and my ability to obtain credit for personal and house purposes. ( B ) Information alleged to result from identity theft If a consumer submits an identity theft report to a person who furnishes information to a consumer reporting agency at the address specified by that person for receiving such reports stating that information maintained by such person that purports to relate to the consumer resulted from identity theft, the person may not furnish such information that purports to relate to the consumer to any consumer reporting agency, unless the person subsequently knows or is informed by the consumer that the information is correct. Under the FAIR DEBT COLLECTION PRACTICES ACT, I have the right to request and receive validation of the alleged debt. Also you have committed the following FDCPA Violations you are sending deceptive forms making false belief that I owe you. 15 U.S. Code 1692j - Furnishing certain deceptive forms ( a ) It is unlawful to design, compile, and furnish any form knowing that such form would be used to create the false belief in a consumer that a person other than the creditor of such consumer is XX/XX/XXXX Disputing Account # XXXX participating in the collection of or in an attempt to collect a debt such consumer allegedly owes such creditor, when in fact such person is not so participating. I am not participating in the collection of this alleged debt.
