Consumer Narrative
Dear Self Financial , Inc., Thank you for your prompt response to my complaint filed through the Consumer Financial Protection Bureau ( CFPB ). I appreciate the thorough investigation you conducted and the summary of your findings regarding my account. However, I must respectfully disagree with your conclusions. Allow me to address the points raised in your letter : 1. **Credit Builder Account Details : ** While it is accurate that a Credit Builder Account ( CBA ) was opened on XX/XX/XXXX, I made 16 successful payments with the last payment posting on XX/XX/XXXX. Despite this, the reporting of my account as delinquent on XX/XX/XXXX, following a missed payment, raises concerns. The reporting of delinquencies and the closure of the account on XX/XX/XXXX due to non-payment do not align with the accurate timeline of my payments. 2. **Furnishing of Information : ** You mentioned that the information furnished to credit reporting agencies is allowed per the privacy disclosure and terms of service agreed upon during the application process. However, under 15 USC 1681 Section 602, I have the right to privacy, and 15 USC 1681 Section 604 ( a ) ( 2 ) states that a consumer reporting agency can not furnish an account without my written instructions. I never provided written instructions for you or any creditors to furnish this information, constituting a violation of 15 USC 1681b. 3. **Data Furnisher Role : ** While Self Financial, Inc. may not be a consumer reporting agency, as a data furnisher, the obligation to ensure accurate reporting remains. It is imperative that the furnished data is not misleading or inaccurate, as stipulated by the Fair Credit Reporting Act. 4. **Statement Delivery Timeframes : ** I acknowledge your compliance with the regulation regarding statement delivery timeframes. However, under 15 USC 1666b, a creditor may not treat a payment on a credit card account under an open-end consumer credit plan as late for any purpose unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement, including the information required by Section 1637 ( b ) of this title, is mailed or delivered to the consumer not later than 21 days before the payment due date. Despite your claim of providing statements 24 days prior, the occurrence of discrepancies in the reporting suggests potential lapses in this process. Given these points, I urge you to re-evaluate the reported delinquencies on my account. The inaccuracies and misleading information have significantly impacted my credit report and caused undue stress. Furthermore, under 15 USC 1681 Section 602, I have the right to privacy, and 15 USC 1681 Section 604 ( a ) ( 2 ) states that a consumer reporting agency can not furnish an account without my written instructions. I never gave you or the above-listed creditors any written instruction to furnish any information on my consumer report, which is a violation of 15 USC 1681b . Additionally, pursuant to 15 USC 1666b, a creditor may not treat a payment on a credit card account under an open-end consumer credit plan as late for any purpose unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement, including the information required by section 1637 ( b ) of this title, is mailed or delivered to the consumer not later than 21 days before the payment due date. In accordance with the Fair Credit Reporting Act, I request a thorough re-investigation of these items and the removal of any information that can not be verified. I understand that under 15 U.S.C. Sec. 1681i ( a ), this investigation must be completed within 30 days of receipt of this letter. Please provide me with an updated copy of my credit report reflecting the requested changes. I appreciate your attention to this matter and look forward to a resolution. Should you require further information, please do not hesitate to contact me. Sincerely, XXXX XXXX XXXX XXXX XXXX XXXX XXXX, GA XXXX Phone : XXXX
