My name is XXXX XXXX. XXXX XXXX is my spouse. We can both be contacted via the email provided. 21st Mortgage Corporation has been taking our payments for months yet reporting to credit reporting agencies that we have not made said payments. They accept the payments, The money is removed from our account, then they claim that we have not caught up completely so our payments are not applied. Further, they seem to be using an 'in-house ' legal service of paid employees and charging us legal fees as if they were paying outside attorneys/consultants. They have us as having racked up over {$5000.00} in legal fees and we do not know what to believe is true/accurate. Additionally, the CFPB has had a cease-and-desist ordered issued on this loan in the past due to outrageous and harassing collection procedures. We do not know if cease-and-desist orders have an expiration date, but the phone calls have resumed despite our repeated requests to stop calling us. We have successfully communicated via postal mail as well as email in the past and there is no reason for harassing phone calls. This loan was purchased by 21st Mortgage from another loan servicer and we have discussed the cease-and-desist carryover with the purchase of the loan. They are well aware of our stance on phone calls, yet they belligerently flaunt their power of collection means. Today, we received a notice of civil action to foreclose. The notice reads that on XXXX XXXX 2024, we were given notice of intent to foreclose and that the notice is attached to the complaint. The notice is not attached to the complaint and we had never been given a notice of intent to foreclose.
