Consumer Narrative
This started around a year ago if not a little more. Calls came in from spam likely and the representatives refused to identify themselves just that they were collecting a debt. I've referred to how they've attempted to collect this as mafia-esque tactics due to how ridiculous it's gotten. After telling them to get bent because they refused to identify themselves I didn't hear from them until very recently when I got a letter stating that a default judgment has been made in a case against me. They state that because a roommate ( whom I have no relations to at all and additionally was in the process of trying to settle legal action against ) accepted a document and then proceeded to never tell me about or give it to me that I have been served. When presenting the very obvious argument that when it comes to taxes a " household '' defines the FAMILY that lives with you, I do not file taxes and include my roommates as my " household '' so they should not be able to accept legal documents in my behalf. The wording of the law regarding serving paperwork is very clearly intended to state that it can't be handed to someone's XXXX XXXX XXXX child. It has to be an adult who is part of the household and therefore a reliable party to deliver the paperwork to. A random roommate does not fit that criteria. Since then I've been in continued contact with their lawyers who repeatedly tell me everything is just my opinion and they're following the rules to a T ( allegedly ) so there's nothing I can do unless I want to find a lawyer and navigate through the legal system to push back. The lawyer then eventually decided to stop emailing me despite my stating I wanted to keep communication digital following his refusal to pull up a previously recorded phone call. He claims that he remembers exactly what was said so there's no need to. In the same conversation he stated that he has a lot of conversations and can not remember every detail of every conversation which was what prompted the request for a call review to begin with. They've refused to escalate my case, and just continue to make it seem like they'll ruin my life over a couple of XXXX dollars. From the beginning I've maintained that I'm perfectly willing to make a payment offer, but I want to validate they own the debt and get a clear amount of what's owed as they state they have multiple accounts and the 240 page document nowhere seemed to state clearly " this is the amount you owe us ''.
