I am writing regarding my Account # [ XXXX ]. Capital One Auto Finance ( referred to as Capital One going forward ) has erroneously reported that my vehicle was subject to a repossession and that my account was charged off. My car was stolen on XX/XX/XXXX and recovered the same day. It was towed to a XXXX XXXX yard where XXXX was supposed to reclaim it. I spoke to Capital Ones representatives at regular intervals explaining the situation after receiving the first phone call from Capital One on XX/XX/XXXX. XXXX claims they attempted to contact Capital One regarding the matter but were met with resistance. Capital One stated they never received a call from XXXX until XX/XX/XXXX. However, I did communicate with Capital One at various intervals regarding the matter of XXXX attempting to reclaim the vehicle. Capital One was paid via ACH on time until Capital One shut down my XXXX payments as of XX/XX/XXXX after receiving my XXXX payment. Capital One proceeded to reclaim my vehicle from XXXXXXXX tow yard on XX/XX/XXXX. I spoke to various Capital One reps and even informed them that XXXX authorized a check be sent to me to get the car from XXXX XXXX. However, my vehicle was moved to auction on XX/XX/XXXX and subsequently sold. Upon hearing this, I paid off the remaining balance on XX/XX/XXXX which was how long it took to figure out what the final balance would be. Capital One repossessed my vehicle even though my payments were current and that I was communicating with them on a regular basis. I sent a demand letter via certified mail on XXXX to Capital One Claims Department at XXXX Capital One XXXX XXXX VA, XXXX. Furthermore, I disputed with XXXX, and they said the document that Capital One Finance replied with was a number to call, that number ended up being the main switchboard for Capital One.
