Received a letter dated XX/XX/XXXX requesting additional documents in order to complete a thorough review of my file and eligibility for loss mitigation services. Letter stated documents needed by XX/XX/XXXX. on XX/XX/XXXX, received a loan modification package in the mail. I had not yet sent in the requested documents so this was a confusing package to receive as I was last told they could not evaluate me for any hoe retention options until they received documents from me. On XX/XX/XXXX, I emailed requested documents to the email address provided in the letter ( see attachment ). Did not receive any furhter communication regarding my application for assistance after sending in the required information. Due to the fact I had not received any further correspondance, and because I was afraid of losing my home, against my better judgement due to the loan modification terms, I completed the loan modification documents in front of a notary and sent them back via XXXX ( they were delivered on XX/XX/XXXX to the XXXX XXXXXXXX XXXX address that I was told to send them to ). I was under impression this would compel LOancare to cancel the notice of default and record it with the County recorder but as of XX/XX/XXXX, I havent received any communication from the lender regarding my acceptance of the loan modification nor of any recordation of a cancellation of the notice of default that was file don XX/XX/XXXX. IT should be noted that I did not receive a copy of the NOtice of Default until XX/XX/XXXX in the mail. This can be verified by Loancare if they jsut check their tracking numbers of the Certified Mail they sent the notice in. It dd not arive to my local post office for pick up until XX/XX/XXXX ( more than a month after it was recorded with the county! ) This is absurd. I was not given appropriate time to respond. They fail to do their job at every turn. The lapse in communication from this lender is beyond ridiculous. They send out documents requesting information and provide a timeline as to when those documents must be recived in order to completely evaluate my loan for a loss mitigation offer, but then they dont even adhere to that timeline themselves. There is a delay in communication between departments it seems and as the homeowber, I am the one who suffers. Being as though I have an XXXXinsured loan, the lender will never lose as XXXX will reimburse the lender the FULL AMOUNT of the loan, so they are never going to suffer any loss. But I will, and its all due to their negligence and unfair business practices. IN the event a foreclosure occurs, I intend to pursue a civil suit and have more than enough legal basis and appropriate case law to support the foreclosure being found null and void. They fail to adhrere to timelines and fail to adequately do their job.
