I have been trying to pay an old fine for the XXXX XXXX XXXX North Dakota for several years. " ProCollect '' in XXXX had been " assigned '' to " assist the city to collect these written off fines. '' I also have several other debts that are older debts than this specific fine for a traffic violation. I have discussed how the Fair Debt Collection Act protects consumers by requiring collection agencies to apply the payment as per the consumer 's instructions and that their policy " to apply the payment to the oldest debt on the account first, '' would be nearly impossible for me as it is a medical debt that exceeds my annual income amount. I have attempted to speak with several people at the debt collector 's office, the attorney general office of North Dakota, the North Dakota Financial institutions Office and the staff and city attorney for XXXX XXXX courts. I have been hung up on by Procollect 's staff and managment because I refused to disclose to them my name ( to Procollect ) as this is really an issue that applies to every person they have debts they are attempted to collect from and not just my individual self. I want XXXX XXXX XXXX XXXX XXXX to be assessed as well because they sent this debt, without notice and without prior expectation that if the debt went unpaid for a specific length of time that they would then " write off '' the debt to be collected by a 3rd party agency. In addition, Procollect, has informed me that once they allow a consumer to satisfy a debt that comes from the municipal court for the XXXXXXXX XXXX XXXXXXXX, the company sends notification back to court staff so that they may then send verification to the XXXX XXXX to release the suspension ( if one was issued ) and restrions in relation to that fine that was turned over to procollect on a consumers ' driver 's license. This violates the Fair Credit Consumer Reporting Act. Procollect has informed me that they receive NO commission for the collection of these debts for any account and they do not " own '' these debts. This violates the Fair Credit Consumer Reporting Act and my right to privacy. North Dakota has assigned the North Dakota Department of Financial Instatutions to " regulate '' such complaints according to online resources and the person I spoke with at ND attorney general 's office. This is also a violation of the Fair Debt Collection Act. Please send me instructions as to how I should proceed so that my complaint continues to become a cause for action at the appropriate level and change can be implemented against the unlawful acts of a government office and it's contracted businesses and their staff.
