XXXX, XXXX, and Experian have violated my personal privacy and have not adhered to the Fair Credit Reporting Act ( 15 U.S.C 1681 ) nor the Privacy Act of 1974 ( 5 U.S.C. 552a ). According to the 15 U.S.C. 1681 section 602 There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. I have the right to make sure my private information isnt shared which is backed by 15 U.S.C. 6801 which states It is the policy of Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. ( Furnishers of information to credit agencies ) is a financial institution by definition under that title. I have called multiple times to XXXX and Experian and mailed correspondence to XXXX to resolve these disputes but was not able to come to a resolution. Important Definitions : The term record means any item, collection, or grouping of information about an individual that is maintained by an agency, including, but not limited to, his education, financial transactions, medical history, and criminal or employment history and that contains his name, or the identifying number, symbol, or other identifying particular assigned to the individual ... This includes consumer reports. ( b ) Conditions of Disclosure - No agency shall disclose any record which is contained in a system of records by any means of communication to any person, or to another agency, except pursuant to a written request by, or with the prior written consent of, the individual to whom the record pertains, unless disclosure of the record would be to a consumer reporting agency in accordance with section 3711 ( e ) of title 31. Section 3711 ( e ) of Title 31 States that when trying to collect a claim of the Government under a law except the Internal Revenue Code of 1986 ( 26 U.S.C. 1 et seq. ), the head of an executive, judicial, or legislative agency shall disclose to a consumer reporting agency information from a system of records that a person is responsible for a claim if : ( E ) the head of the agency has established procedures to ( iii ) get satisfactory assurances from each consumer reporting agency that the agency is complying with all laws of the United States related to providing consumer credit information ; I have written and called to have my non-public personal information provided by institutions without my consent, to include ( inquiries and charge-offs ) removed from the credit bureaus to no avail. Charge-offs are considered certificates of indebtedness and are considered income per the I.R.S. manual. Income can not be reported on my credit file. Per XXXX C.F.R. XXXX ( a ) ( XXXX ) - Purpose and scope which governs the treatment of nonpublic personal information about consumers by the financial institutions, and to more pertinently provide a method for consumers to prevent a financial institution from disclosing that information to most non affiliated third parties by opting out of that disclosure, subject to the exceptions in XXXX, XXXX, and XXXX. XXXX XXXX. XXXX - Initial privacy notice to consumers required. XXXX XXXX. XXXX - Form of opt out notice to consumer ; out out methods. ( XXXX ) Form of opt out notice. If required to provide an opt out notice under XXXX ( a ), you must provide a clear and conspicuous notice to each of your consumers that accurately explains the right to opt out under that section. The notice must state : i.That you disclose or reserve the right to disclose nonpublic personal information about your consumer to a non-affiliated third party ; ii.that the consumer has the right to opt out of that disclosure ; and iii.A reasonable means by which the consumer XXXX exercise the opt out right. The Bureaus and the XXXX institutions per section XXXX C.F.R. XXXX ( g ) ( h ) ( i ) have a duty to have : g. Compliance with consumers opt out direction as soon as reasonably practicable after received is mandatory. h. A consumer XXXX exercise the right to opt out at any time. i. ( XXXX ) A consumers direction to opt out under this section is effective until the consumer revokes it in writing or, if the consumer agrees, electronically. No such compliance was awarded to me during from XXXX of XXXX to XXXX of XXXX and and I have not/nor will I opt in to having my personal information shown without my consent. Under XXXX XXXX. XXXX - Obligations with respect to disclosures of personal information. ( b ) Opt out ( B ) the consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party; and ( C ) the consumer is given an explanation of how the consumer can exercise that nondisclosure option. Further breaches of my privacy occurred per XXXX U.S.C. XXXX - Permissible Purposes a ) Accuracy and fairness of credit reporting XXXX XXXX makes the following findings : XXXX. ( XXXX ) There is a need to ensure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. b ) Reasonable procedures i.It is the purpose of this sub-chapter to require that consumer reporting agencies adopt reasonable procedures for meeting the needs of commerce for consumer credit, personnel, insurance, and other information in a manner which is fair and equitable to the consumer, with regard to the confidentiality, accuracy, relevancy, and proper utilization of such information in accordance with the requirements of this sub-chapter. XXXX XXXX. XXXX- XXXX pertains to the duty of the CFPB per the XXXX XXXX XXXX XXXX of XXXX ( XXXX XXXX. XXXX et seq. ). Subject to subtitle B of XXXX XXXX. XXXX, this sub-chapter and the regulations prescribed thereunder shall be enforced by the XXXX XXXX XXXX XXXX XXXX, The Federal functional regulators, the State insurance authorities, and the Federal Trade Commission with respect to financial institutions and other persons subject to their jurisdiction under applicable law. I retain the right to opt out and the credit bureaus must comply as soon as reasonably practicable after numerous times of sending notice. The financial institutions and the XXXX reporting agencies XXXX, Experian, and XXXX, do not have my consent to furnish this information and they surely do not have my written consent.
