XXXX ) Non-profit organization established in the State of Colorado exempt from the Colorado Common Interest Ownership Act representing themselves as a XXXX XXXX. XXXX ) We have provided a rebuttal to each invoice the organization, XXXX XXXX XXXX XXXX XXXX XXXX, has issued citing terms in the XXXX & XXXX that were violated. XXXX XXXX XXXX employed XXXX debt XXXX and XXXX lawyers prior to having a statutory XXXX placed on our property. Claim, crossclaim, and counter filed in XXXX XXXX XXXX in Colorado. XXXX issued XXXX XXXX Order which forced Opposing Counsel to reissue claim due to factual errors by Opposing Counsel but has not been accepted by Judge to date. OC changing from statutory XXXX to judgement XXXX. XXXX ) XXXX contacted our mortgage holder, XXXX XXXX XXXX Bank, stating that they had filed a lien against our property and were moving to foreclose on the property if they did not pay off the amount due. At no time did they inform XXXX that they would need a judgement as the statutory XXXX was spurious ( no statutory authority, not requested with State Regulators, and attempting to collect non-awarded legal fees ). XXXX issued a letter to XXXX on XX/XX/year>, demanding an amount due which was not supported by invoice or Delinquency Notice and, demanded payments on properties not covered by XXXX ( mortgage ). XXXX reissued letter on XX/XX/year> to XXXX demanding an amount significantly increased as they moved charges from XXXX property to the property covered by the mortgage. The amount in that letter is not supported by invoices sent from the Associations CPA. XXXX ) We believe that the XXXX ( XXXX ) was in fact attempting to mislead our mortgage company into paying a significant amount of what their client was demanding and all legal fees which have not been awarded and would then withdraw their claim with the courts. This would prevent them from having to address the spurious XXXX. XXXX and our counsel discussed the fact that we would proceed with our counter claims and concluded that XXXX would reissue their claim to remove inaccurate information. XXXX ) OC has neither removed the spurious lien from our properties nor have they attempted to revise or revoke their demand for extraordinary payment from our mortgage company. XXXX ) OC ( XXXX ) was recently issued a public censure violating XXXX XXXX XXXX ( c ) ( it is professional misconduct for a lawyer to engage in conduct involving dishonesty, fraud, deceit, or misrepresentation ). The case file is public per C.R.C.P. XXXX ( a ). We believe that she also provided dishonest, fraudulent, deceitful, and misrepresented information to our mortgage holder to advance her own financial position. She did not rely on information provided to her by others as she had the facts and figures from her XX/XX/year> letter and previous debt collection action, our response, and her validation. She was also well aware that she had filed a legal action that contained inaccurate information.
