I have already applied for discharge for this loan. See complaint XXXX. This loan should be discharge under the " fruit of the poisonous tree '' statute. This original loan was a part of a lawsuit that has granted the discharge of loans associate with the defrauding of the borrowers. Regardless of it being now private, this should be covered under the above statute. I will be suing PenFed if this is not discharged.
