I continue to face financial difficulties and struggle to get ahead as a direct result of PNCs actions when I requested their assistance after suffering several setbacks. They forced me to file bankruptcy to save my home from foreclosure and although I was doing what they asked and following their instructions to request hardship assistance they were working behind my back to move forward with foreclosure. They have denied any wrong doing and claim their actions were because I failed to complete the required trial period payments. That is a lie that PNC has told multiple times over the last few years. The bankruptcy trustee stated, under threat of perjury, that he submitted all three trial period payments as required. He stated the first two payments Were accepted but the third and final payment was returned to him. Along with the returned check was a letter citing the payment was being returned because the motion for relief from stay has been granted and requested that no additional funds be sent. So they went back on the agreement and essentially revoked the modification that I had already been qualified and approved for. They went on to successfully motion for the dismissal of my bankruptcy. That is the reason for my complaint today. Since XX/XX/XXXX I have been fighting a garnishment that stems from a XXXX medical bill, that was never submitted to my insurance company for payment, that resulted in a default judgment being awarded in XXXX to XXXX XXXX XXXX. This debt was listed in the bankruptcy I filed in XXXX and would have been discharged if not for PNCs dishonest and illegal actions. I have been a full time paid caregiver for my severely disabled adult son since XXXX. My wages are qualified XXXX waiver payments, and are not reported as income by the consumer directed employer. According to ( 42 U.S.C. 1396a ( a ) ( 32 ) and 42 C.F.R. 447.10 ) as well as Washington State law ( Wash. Rev. Code 74.08.210 ) these funds are exempt from garnishment and that was true until XXXX but for some reason XXXX dont understand they are now being allowed to garnish those funds. I contacted PNC in XXXX of XXXX asking for assistance with my mortgage and was mislead every step of the way since. The amount of money and time Ive lost directly related to PNCs actions and ongoing deception is hard if not impossible to quantify. They may continue to deny their actions and role in my financial situation but I will continue searching for answers and holding them accountable for their actions. I have a not yet filed motion that I had prepared along with several pieces of evidence I would like to submit for review.
