I am a victim of identity theft- on XX/XX/XXXX or XXXX someone used the drivers license from my stolen wallet to get an over $ XXXX auto loan to finance the purchase of a car from XXXX and register it under my name. Naturally, they haven't paid the loan, which is still on my credit. I filed a police report ( XXXX with XXXX XXXX XXXX XXXX, FTC identity theft report ( XXXX - attached ), a California XXXX fraud report ( XXXX ), and initiated investigations to remove the fraudulent installment account at Equifax and XXXX. On XX/XX/XXXX I received a letter from Equifax dated XX/XX/XXXX stating the following about the XXXX XXXX XXXX installment account : " THE DISPUTED ITEM IS NOT CURRENTLY REPORTING ON THE EQUIFAX CREDIT FILE. '' That same day, I checked my Equifax consumer report, and I see the disputed items still being reported. Regarding the several inquiries that were fraudulently made for car loans, Equifax refused to remove them, stating " INQUIRIES ARE A FACTUAL RECORD OF FILE ACCESS ''. These inquiries were the fraudulent result of identity theft, and I provided the information to Equifax to demonstrate this. It's hard enough dealing with identity theft, Equifax is actively making my life more worse. These are violations of XXXX5 USC 1681c-2 ( a ) for refusing to block information resulting from identity theft, 15 USC 1681b ( a ) ( 2 ) for furnishing a consumer report in accordance with the written instructions of the consumer to whom it relates, 15 USC 1681e ( b ) for failing to follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates, and 15 USC 1681n ( a ) for willful non compliance of deleting unauthorized items from my consumer report. XXXX, which wrote this fraudulent loan and sold the car, has also been useless. Despite promisingly to diligently investigate this fraud, instead they just began sending me billing statements for the fraudulent and increasingly delinquent account. Their bill was sent on XX/XX/XXXX, after I initiated the investigation.
