In XXXX of XXXX my father-in-law passed away, he had an existing mortgage held with Bank of Albuquerque ( conventional loan ) with a balance of about $ XXXXHe signed this loan in XX/XX/XXXX. The mortgage company offer forbearance well covid was happening, they offered this for about 18 months. We started probate in XXXX of XXXX and in XXXX of XXXX we received the deed for the property ( my wife his daughter is was the executive of the estate ). We submitted this documents to XXXX and at the end of the forbearance which was in XXXX of XXXX they billed us for all past payments and accelerated the loan, it was about {$20000.00} due that we could not afford to pay. From my understanding they are not legally allowed to do, because even as of now they have not allowed us assume the loan or even refinance. I took us a year of going back and forth but by the end of XXXX they started to foreclose, and in XXXX of XXXX we learned about the home loan grant ( at this point the loan was now at around {$110000.00}. My wife was able to apply for the grant was approved, we applied the {$30000.00} grant plus around {$8900.00} out of pocket to make the loan current and they proceed a reinstatement. This took them 6 months, so by XXXX of XXXX it was completed. They have yet to let us assume this loan and is still under the XXXX of Mt father-in-law. I have been told by attorney that they should not have done this to us and if breaking their fiduciary responsibilities. I would like some help please and if you have any question please reach out.
