i was working with the realtor to complete a short sale had a commitment from the buyer also due to the fluctuation in the interest rates the borrower and there lender was finalizing the deal my bank along with the lawyers went ahead and went into court got a sale date and said to the agent only way they would stop it is if the deal would include and additional XXXX within XXXX hours. i went to court the judge signed a XXXX XXXX XXXX i wanted to go in front of the judge at time of hearing to explain the case i wasnt told when the hearing was held the judge dimiss the complaint. now they are acting as if they entertaining the buyer as in bad faith telling us they have to get the final approval for short sale mean while have a sale date again for XX/XX/XXXX XXXX pending and holding XXXX XXXX. i worked out a modification with them in XXXX when i was giving no choice but to give them XXXX which i did and inturn i got and unfavorable situation with adjustable rate and high payment. recently i went to the court and looking into the file i notice that they also made false claims that in XXXX that i wasnt eligble for a settlement confrence because my property wasnt owner occupied which is false they knew that i did live there infact i have lived at that same residence since i obtained the property. they aslo mark me as a no show for the confrence which i had no idea was even taking place in a afidavit of service they went to my mothers address which is XXXX XXXX XXXX XXXX XXXX they stated that they served my cousin XXXX XXXX i just learned of this just a week ago looking in the files at the court we dont have anyone ever in the history of my family name XXXX XXXX XXXX i had a attorney handling the case during the XXXX his name was XXXX XXXX he passed away so alot of the documents was with him so its taking a little time for me to gather everything to show you.
