I received my annual escrow analysis from NewRez LLC, my mortgage company. and Informed I had a surplus in my XXXX account for {$1100.00}. The statement was dated XX/XX/year>. As a XXXX resident I have the option of receiving a refund check for that amount or chose to apply it towards my principle or escrow account. I sent an enclosed form requesting for a refund check. That form was sent out on XX/XX/XXXX. After over a month I still hadn't received the check. I contacted a service rep on XX/XX/XXXX and I was told that the check was sent out on XX/XX/XXXX. He said that they would receive another check with XXXX to XXXX days. Check has never arrived. I contacted another service rep who also said that the check was sent out on XX/XX/XXXX. That is not true because as a XXXX resident a refund check can not be issued until I request that refund. There is no way they could receive my request for refund prior to them sending out a check. This is under XXXX law requiring the borrower to submit a request for refund or hold for escrow. Again according to law I should of received this check within XXXX days of the analysis, date XX/XX/XXXX, XXXX I was then told my funds would be direct deposit in XXXX days. The second rep I talked to said that they would direct deposit to my account, that never happened. Both reps mislead me and Newrez is not abiding by XXXX mortgage escrow refunds law..
