Burns Auto Credit LLC has used unfair & deceptive acts pertaining to holder in due course rule. The proper NOTICE was enter in the contract : NOTICE ANY HOLDER OF THIS CONSUMER CREDIT CONTRACT IS SUBJECT TO ALL CLAIMS AND DEFENSES WHICH THE DEBTOR COULD ASSERT AGAINST THE SELLER OF GOODS OR SERVICES OBTAINED PURSUANT HERETO OR WITH THE PROCEEDS HEREOF. RECOVERY HEREUNDER BY THE DEBTOR SHALL NOT EXCEED AMOUNTS PAID BY THE DEBTOR HEREUNDER. : However, under notice - it contain additional language with limitation & restriction on my right to assert any claims and defense as note holder per Federal Trade Commission Staff Guidelines on Trade Regulation Rule Concerning Preservation of Consumers ' Claims and Defense. PER Federal Trade Commission if contract has additional recitals which limit or restrict its application, I as the consumer may assert, by way of claim or defense, a right not to pay all or part of the outstanding balance owed the creditor under the contract ; but the consumer will not be entitled to receive from the creditor an affirmative recovery which exceeds the amounts of money the consumer has paid in.
