Consumer Narrative
On XXXX, XXXX, XXXX I checked my consumer credit report and noticed that the company, XXXX XXXX, was reporting on it, for the second time, without my written permission to do so. I had already filed a CFPB complaint against XXXX XXXX ( case # XXXX filed XX/XX/XXXX ) for attempting to collet a XXXX I did not owe them and for violating the Fair Debt Collection Practices Act and violating a " Cease and Desist '' demanding they stop contacting me about a debt sent to them on XX/XX/XXXX ( Certified Mail # XXXX XXXX XXXX XXXX XXXX with PS Form XXXX # XXXX XXXX XXXX XXXX XXXX XXXX signed by XXXX of their agents on XX/XX/XXXX ). I disputed this debt with the the XXXX credit reporting agencies and the end result was the account being " REMOVED '' from my consumer credit report. XXXX XXXX did not have permissible purpose then and STILL does not have permissible purpose now to furnish my personal consumer information to any consumer reporting agencies and report inaccurate information to it. I have not entered any consumer credit transactions with this company, have never done business with this company, and have never given them my written permission or any type of permission to obtain my personal information and furnish any information to anyone, therefore, XXXX XXXX is reporting to my report without my permission and violating my right to privacy. I believe their intent is to bring harm to my Person and ruin my credit worthiness and coerce me into paying a debt I am not obligated to pay. This is unlawful. This also shows a " willful noncompliance '' on the part of XXXX XXXX per XXXX XXXX subsection XXXX, as this is my second time filing a complaint against them for reporting to my consumer credit report without my written consent and, again, directing them to not do so. According to the Fair Credit Reporting Act XXXX XXXX XXXX section XXXX states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX Equifax and XXXX are consumer reporting agencies and I am the XXXX. I have the right to make sure my private nonpublic information is not shared with just anyone. Per XXXX XXXX XXXX Section XXXX section XXXX states that " In general Subject to subsection ( c ), any consumer reporting agency XXXX furnish a consumer report under the following circumstances and NO OTHER : in accordance with the WRITTEN INSTRUCTIONS of the consumer to whom its relates. '' XXXX XXXX Equifax XXXX and XXXX do not have my written consent, and all any and all consent, whether implied, verbal non-verbal or otherwise is revoked per XXXX CFR subsection XXXX, which states that " a consumer XXXX exercise the right to opt out at any time. This is Notice that I opt-out. XXXX XXXX XXXX XXXX XXXX ( A ) ( XXXX ) states " A person shall not furnish any information relating to a consumer to any consumer reporting agencies if the person knows or has reasonable cause to believe that the information is inaccurate. '' I know this information is inaccurate and does not belong on my consumer credit report and should be removed immediately. XXXX XXXX XXXX states " Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section XXXX of this title and to limit the furnishing of consumer reports to the purposes listed under section XXXX oof this title. '' Equifax XXXX XXXX are not maintaining reasonable procedures, as I have already disputed this account previously and it was " REMOVED '' previously.
