I purchased the property XX/XX/XXXX and obtained a mortgage from XXXX. Purchase price was {$300000.00}. Mortgage amount was {$240000.00}. On XX/XX/XXXX I reached out to XXXX regarding RESPA/TILA violations. I was overcharged on recording fee 's and seen a few other discrepancies that I wanted clarification on. Letter dated XX/XX/XXXX XXXX responded by admitting there was/were error ( s ) and provided a refund of {$19.00} but the overage was approximately {$50.00} from what I counted. Letter dated XX/XX/XXXX was a Notice of Servicing Transfer from XXXX to XXXX XXXX. XXXX dated XX/XX/XXXX XXXX stated they will be servicing the mortgage as of XX/XX/XXXX. However, XXXX XXXX XXXX ( XXXX # XXXX ) was NOT licensed as a Mortgage Servicer. XXXX did NOT create, negotiate or own the loan. A letter dated XX/XX/XXXX from XXXX XXXX XXXX XXXX XXXX has purchased your mortgage loan and stated the current servicer is XXXX XXXX. On XX/XX/XXXX there was an Assignment of Mortgage recorded with XXXX, as Mortgagee/Nominee for XXXX to XXXX Mortgage. The assignment was done by XXXX XXXX, XXXX XXXX for XXXX, as Mortgagee/Nominee for XXXX. The XXXX was prepared by XXXX XXXX. I have reason to believe XXXX XXXX is a XXXX based on another document with his signature. The assignment was corporate and done WITHOUT a witness. A letter dated XX/XX/XXXX from XXXX XXXX as debt collector stated " we are trying to collect a mortgage debt held by Freedom Mortgage and serviced by XXXX XXXX. A letter dated XX/XX/XXXX stated the servicing of your loan is being transferred to Freedom Mortgage on XX/XX/XXXX. XXXX XXXX is acting suspicious. On XX/XX/XXXX there was another Assignment of Mortgage recorded with Freedom Mortgage Corporation as Attorney In Fact for XXXX to Freedom Mortgage. The assignment was done by XXXX XXXX, Coordinator, Lien Release for Freedom Mortgage. I found several different signatures for XXXX XXXX and am sure this is a XXXX. The assignment was corporate and done WITHOUT a witness. This XXXX was notarized by XXXX XXXX. This XXXX was created by XXXX XXXX with return to Freedom Mortgage address. I have found numerous different signatures for XXXX XXXX and XXXX XXXX. A letter dated XX/XX/XXXX from Freedom Mortgage stated " your forbearance plan is effective XXXX. A letter dated XX/XX/XXXX stated " your forbearance plan is effective XXXX. However, on XX/XX/XXXX ( during the Forbearance period ) Freedom Mortgage by their attorney XXXX XXXX filed a Foreclosure Complaint in Court to start foreclosure proceedings. I did not receive Act 6, Act 91, Notice of Intent to Accelerate and Notice of Default. Freedom Mortgage does not have any records I requested to prove they have the right to collect/foreclose. Freedom Mortgage was assigned the mortgage on XX/XX/XXXX. I requested proof they own the mortgage and note from them but they ignore the law. Instead they placed me into Forbearance from XXXX. On XX/XX/XXXX I filed an Answer to the Complaint and requested documents. They ignored. I updated my address with them but they still sent paperwork to the subject property address only. I was not staying with my family at the time due to my wife and I being separated after she was served with the Complaint on XX/XX/XXXX. We have fixed our issues and I am back with my family at the house as of approximately XX/XX/XXXX. I got back home to find a lot of mail from XXXX XXXX and/or Freedom Mortgage, including Court filings that I was not able to respond to due to Freedom Mortgage and KML Law not following the rules and sending me important documents at " last known address '' which I provided to them a few times but also in the Answer to the Complaint. On XX/XX/XXXX I sent Freedom Mortgage and XXXX XXXX discovery requests. They have not responded. Similar requests was sent on XX/XX/XXXX. I gave them my cell phone number, email address and temporary mailing address. Now, I see that they did a whole lot of litigation without me knowing about it. There is an auction scheduled for XX/XX/XXXX and I need help. If Freedom Mortgage was assigned the mortgage on XX/XX/XXXX and they placed the loan into forbearance from XXXX ( two forbearances ) how could they file a foreclosure complaint on XX/XX/XXXX? They never sent any pre-foreclosure notices causing harm to me because I did not know how much was owed, by what date it needed to be paid, where to send the payment, how much time I have before they start foreclosure, etc .... I did some research and see that this issue is not just with me, it's starting all over again like in XXXX. The assignments are illegal or not perfected. I have already requested through XXXX request a copy of XXXX XXXX XXXX signature which is on file with XXXX XXXX NJ XXXX required by all notaries. I am getting ready to request the same for the XXXX XXXX assignment in South Carolina. It seems South Carolina and New Jersey have different rules for notarizing corporate documents which make it easier for them to lie, cheat, break the law and get away with it. The assignments prove a break in chain of title. How did Freedom Mortgage get a mortgage assignment from XXXX if XXXX owned the loan? I believe this loan got securitized and the actual note was delivered to a trustee. This is deceit. It's very likely that Freedom Mortgage does not have a right to collect or foreclose. I need time to litigate all issues surrounding this but won't have time since auction is XX/XX/XXXX and Freedom Mortgage and XXXX XXXX are ignoring my requests. It seems there is no remedy. I'm not the only one dealing with this. It's unfair practice. Please reach out to them or me and provide guidance. Thank you!
